By accessing or using arcwp.ca and our products including ARC Suite, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Subject to your compliance with these Terms, ARC Software grants you a limited, non-exclusive, non-transferable license to:

• Access and use our website and services for your personal or commercial purposes
• Download and use our products in accordance with their respective licenses
• Access documentation and support materials

Restrictions

You may not:

• Modify, reverse engineer, or create derivative works of our products without authorization
• Remove or alter any proprietary notices from our products
• Use our products for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Resell or redistribute our products without proper licensing
• Use our services to transmit malicious code or harmful content

Account Registration

Refunds and Cancellations

Our refund policy is as follows:

• Digital products: 30-day money-back guarantee
• Subscriptions: Cancel anytime; no refunds for partial periods
• Support services: Refunds on a case-by-case basis

Intellectual Property

The services and their original content, features, and functionality are owned by ARC Software and are protected by international copyright, trademark, and other intellectual property laws.

ARC Software, ARC Suite, ARC Forge, ARC Gateway, ARC Blueprint, and related logos are trademarks of ARC Software.

User Content

You retain ownership of content you create using our products. By using our services, you grant us a license to host, store, and process your content to provide our services.

Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit spam, chain letters, or unsolicited communications
• Impersonate any person or entity
• Interfere with or disrupt our services
• Collect or harvest information about other users

Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

Limitation of Liability

To the maximum extent permitted by law, ARC Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

You agree to indemnify and hold harmless ARC Software from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

Updates and Support

We may provide updates to our products at our discretion. Support services are provided according to your service level agreement or as otherwise specified in your product documentation.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any breach of these Terms or at our sole discretion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.
